TK Quarter Horses AI, Mare Care, and Foaling Services Contract

This Contract is for the season of ______is made and entered into on this ____day of ___________________ by and between TK Quarter Horses, hereinafter designated BREEDER, and ________________________________, hereinafter designated MARE OWNER. BREEDER agrees to care for the mare: _____________________________, Breed _________________________Registration No. ___________________________at TK Quarter Horses, subject to the following conditions:

  1. Mare Owner agrees to pay $150 to have mare foal on Breeder’s premises. Mare Owner shall pay all Veterinarian and medicine expenses incurred in conjunction with foaling and mare care. Mare care of $8.00 per day will be charged to the mare owner. Mare care is in addition to the foaling fee.
  2. Mare Owner agrees to pay minimum fee of $150.00 payable in advance upon execution of this contract. for Transported Cooled Semen Receiving/ breeding Service. Service fees include mare care and required daily stallion teasing is $8.00 per day, mare handling fee for veterinarian is $7.00 per incident, artificial insemination (AI) fee at $23.00 per incident, courier fee to retrieve semen is $15.00.
  3. . Mare owner will provide horse blankets, special equipment needs, special feeds and supplements at Mare owner‘s expense.
  4. Mare Owner agrees to pay all fees and other expenses owed Breeder when the mare is picked up. Mare Owner may not remove the mare from Breeder’s possession until all expenses are paid in full.
  5. Breeder agrees to provide suitable facilities for the care and feeding of mare and/or foal while in his custody. Breeder will exercise judgment consistent with recognized standards in care of mare and/or foal.
  6. For artificial insemination (AI) and transported cooled semen (TCS), Mare Owner assumes responsibility of contracting for donor stallion and providing supplemental AI information in attached Schedule A.
  7. Mare Owner will pay all veterinary and medical expenses. The Attending Veterinarian will examine for normal breeding conditions and administer medical care as deemed necessary for the health and safety of the mare and/or foal. The Mare Owner agrees to accept the medical judgment of the Breeders Veterinarian and administration of treatment by the Breeder in regards to performing mare emergency medical treatment, should in the Breeder’s opinion, such treatment be deemed necessary. The Breeder will make a reasonable effort to notify the Mare Owner in the event of a medical emergency.
  8. A mare that is not halter broke will not be accepted. Shoes will be pulled at Mare Owner’s expense.
  9. The mare shall be in a healthy and sound breeding condition, free from infectious, contagious and transmittable diseases. A current negative Coggins test, copy of registration papers (both sides) listing mare owner, veterinarian health certificate showing current date of last worming and annual shot record must accompany mare’s arrival at TK Quarter Horses. If they do not, mare may be rejected. If accepted, Breeder’s veterinarian will examine and/or test mare at Mare Owner’s expense. Breeder reserves the right to refuse mare if in the opinion of the Breeder, mare is not in satisfactory condition.
  10. Both parties agree that Troy Kurth, TK Quarter Horses, their agents or employees are not liable for death, sickness and /or accident including consequential damages caused to the mare and/or foal unless such death, sickness and/or accident was by willful and wanton gross negligence of the Breeder.
  11. This contract is non-assignable and non-transferable.
  12. This contract is entered into in the State of Montana and will be interpreted and enforced under the Laws of Montana. If any clause in this contract is against State Law, then that clause shall be null and void. The balance of the contract will remain in force. Should either party breach this contract, the breaching party shall pay for the other’s court costs and attorney’s fees related to such breach.
  13. This Contract represents the entire agreement between the parties. No other agreements or promises verbal or implied are included unless specifically stated in this written Contract. Additional conditions should be individually initialed by each party If none, initial here _____/_____, or add as Schedule B, Condition 17 on a supplemental page.
  14. When Mare Owner and Breeder sign this contract it will be binding on both parties subject to the above terms and conditions.
