TRANSPORTED COOLED SEMEN STALLION BREEDING CONTRACT
This TRANSPORTED COOLED SEMEN STALLION BREEDING CONTRACT
for the year 2000 breeding season, made and entered into on this _____day
of __________, 19___, is by and between TK Quarter Horses,
hereinafter designated Stallion Owner, and _________________________________
hereinafter designated Mare Owner. Mare Owner agrees to breed Mare __________________________,
Breed _________ Reg. _______, to the Stallion _______________________ AQHA
Reg. No. ________ for the Stud Fee of $500.00 for a live foal, subject
to the following conditions:
1. The stud fee includes a non-refundable booking fee
of $150 payable with this contract. The stud fee balance of $350 must be
paid before semen is shipped.
2. Stallion owner agrees to ship semen as described in
Attachment 1 dated 1/1/00. If a mare fails to settle, for any reason, Mare
Owner will hold Stallion Owner blameless. Mare Owner agrees to give stallion
Owner ample opportunity to settle mare, and agrees to follow the conditions
described in Attachment 1 dated 1/1/00.
3. Stallion Owner will agree to furnish mare owner two
shipments of semen per mare's cycle if needed (providing no ovulation after
first shipment). These shipments will be shipped as price per shipment
as detailed in Attachment 1 dated 1/1/00.
4. The Mare Owner shall agree that each mare offered
for breeding shall be in sound breeding condition and free from infection
or disease. Any mare certified by the attending Veterinarian not
to be, in his opinion, in sound breeding condition shall not be bred. Should
the mare be found unsuitable for breeding, Mare Owner may substitute another
mare within that breeding season.
5. Live Foal Guarantee. Live foal means the foal shall
stand and nurse. It is understood if the mare proves barren, aborts her
foal or if the foal is stillborn, a return season will be guaranteed for
the 2001 breeding season only, providing notification is given. Proper
notification shall be defined as follows: written certification by a licensed
veterinarian within seven days that the mare has slipped or produced a
non-viable foal. Mare Owner certifies that such abortion or death did not
result from any act or omission of the Mare Owner subsequent to the mare's
departure from TK Quarter Horses. Booster rhinopneumonitis vaccinations
must be administered as indicated by the individual drug manufacturer as
mare progresses through her pregnancy. Failure to do this will void live
foal guarantee. An additional booking fee of $150.00 will be charged for
return season breeding service in 2001.
6. The breeding season in force for this contract shall
begin February 1 and close July 30, 2000.
8. It is further agreed that should the above named stallion
die, or become unfit for service, or, If the above named mare dies, during
the breeding season that the stud fee less the booking fee and expenses
owed will be refunded, if it has been paid in full, thereby canceling this
entire contract. Or if the mare dies or becomes unfit for to breed before
being pronounced safe in foal, the Mare Owner may substitute another mare
or breed the above named mare to another stallion on the farm (if available)
that is agreed to by both the Mare Owner and Stallion Owner.
9. A breeder's certificate will be issued to Mare Owner
after all expenses have been paid in full and upon notification of the
birth of the foal.
10. Waiver of Liability. Both parties agree that TK Quarter
Horses, its owners, employees, veterinarians, and guests shall not be liable
for any injury, escape, disability, or death of any horse on its premises.
The above named Mare Owner, whose horse(s) are under the care of TK Quarter
Horses will not be liable or responsible for any damage, injury, or death
to the breeding farm stallions, employees, veterinarians, or other animals
in the care of TK Quarter Horses, whether or not caused by his horse.
11. This contract is non-assignable and non-transferable.
12. This contract is entered into in the State of Montana
and will be interpreted and enforced under the Laws of Montana. If any
clause in this contract is against State Law, then that clause shall be
null and void. The balance of the contract will remain in force.
12. Both parties agree to settle any disputes to this
contract by arbitration in Missoula, Montana.
13. The following rider is attached hereto and made a
part hereof. Attachment 1, 2 and 3 dated 1/1/00.
14. This contract represents the entire agreement between
the parties. No other agreements, promises, verbal or implied, are included
unless specifically stated in this written Contract. The original contract
will be kept on file at TK Quarter Horses and a copy provided for Mare
Owner. When Mare Owner and Stallion Owner have signed this Contract, it
will then be binding on both parties, subject to the above terms and conditions.

RULES FOR TRANSPORTED SEMEN
A. Stud Fee for Stallion: BADGERS GRAND SLAM, AQHA Reg.
No. 3,422,625 is $500. A non-refundable booking fee of $150 is included
in the stud fee. The booking fee is due with the signed TRANSPORTED COOLED
SEMEN STALLION BREEDING CONTRACT. Mares should be booked early.
B. A copy of the Mare's Registration Papers (Both sides)
must also be included with the signed Contract along with a completed SHIPPING
INFORMATION FORM contained in Enclosure 1.
C. Balance of Stud Fee, $350, is due before first shipment.
D. Equitainer refundable deposit of $275 is also due
prior to the first semen shipment. Deposit will not be refunded if container
is not returned to TK Quarter Horses within 72 hours from semen receipt.
E. IF a disposable container is used in lieu of an Equitainer,
a $30.00 container fee will be deducted from the container deposit for
each container used. The disposable container need not be returned.
F. Each shipping charge is estimated at $57.00 for Fed-Ex
overnight weekday delivery and $67.00 for Fed-Ex overnight Saturday delivery.
Other methods of delivery will be priced upon request. A $20.00 airport
courier charge will be assessed to all counter to counter shipments. Shipments
will be insured to cover only Equitainer replacement and collection fee
costs. If shipment is lost or delayed, Mare Owner assumes all risks of
lost time and expense associated with preparation of his/her mare for breeding.
F. The mare owner is responsible for $100 collection
fee per shipment and all container shipping charges TO and FROM the breeding
farm. Collection and shipping fees will be billed monthly.
G. All Stud Fees, including Equitainer refundable deposit,
must be paid prior to shipping (out of state checks require 10 days to
clear). For your convenience, we do accept Master Card and Visa. If you
wish to use a credit card, A CREDIT CARD AUTHORIZATION FORM, (below), must
be filled out prior to shipment.
H. A finance charge of 1.5% of the unpaid balance will
be charged on all balances remaining due past thirty (30) days.
I. Our Breeding program allows us to ship semen MONDAYS,
WEDNESDAYS, and FRIDAYS. If you have a need outside these days, you must
call us on the day proceeding your need to determine feasibility. We will
make every effort to fill your need.
J. We request you order a shipment the day before you
will need it. YOU MUST REQUEST SHIPMENT BY 0700 AM (Mountain Time) ON THE
DAY THE SEMEN IS TO BE SHIPPED. Cancellations must be received before 1200
Noon (Mountain Time) on shipping day.
K. In the event that not enough semen is collected to
meet a day's breeding and shipping needs, ON SITE MARES WILL HAVE FIRST
PRIORITY. Shipped semen requests will be filled in the order received.
L. Live Foal Guarantee. If the mare does not produce
a live foal in 2001, a rebreed will be allowed for the same mare or a substitute
mare for the 2001 season only. An additional booking fee of $150.00 will
be charged for this rebreed service.
